United States v. Anderson
District Court, District of Columbia
1Opinion of the Court
MEMORANDUM AND ORDER
JOHN H. PRATT, District Judge.
The Court has before it the defendant’s motion for severance of offenses and his motion to suppress identification testimony. Having considered the written pleadings and the arguments of counsel, the Court has determined to grant the motion to sever the first six counts of the indictment, relating to a robbery on March 11, 1972, from the seventh and eighth counts which grow out of an assault with intent to rob on April 1, 1972. However, for the reasons which follow, the Court denies the defendant’s motion to suppress identification testimony.
