1Opinion of the Court

CLARK, Associate Justice.

This is an appeal from a conviction under the Federal Mail Fraud and Conspiracy Statutes. Appellant and certain other defendants were indicted for their use of the mails in connection with the development, promotion and sale of burial lots in the National Capital Memorial Park Cemetery located near Muirkirk, Prince Georges County, Maryland, adjacent to the Washington-Baltimore highway. This appeal is taken from the conviction in the second trial, the conviction in the first having been set aside by reason of the probable bias of one of the jurors.
