WOODS, Circuit Judge.
The evidence upon the trial as appeared by the brief thereof agreed to by counsel, established these facts. The plaintiff was a jeweller in the city of Atlanta in the habit of sending to and receiving from New York City valuable packages by express. He was furnished by the express company with a book containing the blank receipts of the company. On the 8th of February, 1899, he went to the agent of the defendant in Atlanta, with a small package containing four diamond rings valued at $735.
