On November 19, 2002, Durango Georgia Converting, LLC (“Durango”) filed a voluntary petition for relief under Chapter 11 of the Bankruptcy Code and TST Impreso, Inc., (“TST”) did not file a proof of claim in the case. On August 19, 2003, Durango brought an adversary complaint against TST for breach of contract of two separate promissory notes and a security agreement.
