LEWIS, Circuit Judge.
Appellant mined and carried away lead and copper ore of great value from within the boundaries of mining claims belonging to appellee; whereupon the latter brought this suit to quiet it's title, for an accounting and for injunction against further extraction and obtained decree and judgment accordingly, from which this appeal. The ore was found about 1,500 feet vertically under the surface of appellee’s claims.
