This is an appeal by the appellant from a finding and judgment of guilty and consequent sentence in a criminal action which charged the appellant with the offense of robbery by violence and by putting in fear. This cause was tried by the Honorable John A. Carson, Judge Pro Tempore, in Division One of the Marion Criminal Court without the intervention of a jury. Sentence was to the Indiana State Prison for not less than ten (10) years nor more than twenty-five (25) years.
