On February 22, 1991, John Keith was riding a motorcycle when Alex Aguirre allegedly pulled out from an unpermitted commercial driveway into Keith’s path, and the two collided. John Keith and Donna Keith filed this action for damages for injuries resulting from the collision, naming Aguirre, Sherry Shover, the owner of the vehicle driven by Aguirre, the Georgia Department of Transportation (DOT), and James H.
