This appeal is before us from a judgment rendered in the district court of Lubbock county on June 7, 1911, and during a term of court held in that county, and which convened on May 29, 1911, and adjourned on the 10th day of June of the same year. Under the first assignment of error in the brief of appellants J. H. Quinn and wife, and also under the first assignment of error in the brief of appellant J. M.
