Appeal from a judgment of the County Court of Greene County (Battisti, Jr., J.), rendered December 14, 1982, convicting defendant upon his plea of guilty of the crime of attempted assault in the second degree. 11 On September 16, 1982, defendant was indicted for the crime of assault in the second degree (Penal Law, § 120.05, subd 1). At such time, defendant was serving a term of imprisonment at the Coxsackie Correctional Facility and the assault was committed in that facility.
