The facts are not in dispute. We quote from appellant’s brief such as are deemed controlling. .

Prior to October 8, 1909, T. W. Barhydt resided at No. 420 Iowa street, in the city of Burlington, Iowa; the same being an eleven-room brick house, with brick laundry and barn, on a lot 180 x 117 feet, where he had lived con*273tinuously for over forty years.
