Appeal from a judgment of the Supreme Court (Devine, J.), entered August 27, 2009 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CFLR article 78, to review a determination of respondent Civil Service Commission upholding the appointment of Frank Gottlieb to the title of supervising hearing officer.
