This is an action for recovery upon forty-one municipal bonds of the denomination of one thousand dollars *3each, bearing date of July 1st, 1891, alleged to have been issued by the incorporated town of Fletcher, now the town of Aurora, for the purpose of the purchase of a water works system, the total amount of the issue being in the sum of $150,000.00. The plaintiff below, appellee here, alleging that he was a purchaser for value, and prior to maturity.
