Appeal from a judgment of the Supreme Court (Feldstein, J.), entered March 26, 2007 in Clinton County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

Petitioner was convicted of three counts of robbery in the first degree, two counts of robbery in the second degree, grand larceny in the second degree, grand larceny in the fourth degree, two counts of unlawful imprisonment in the first degree and criminal possession of a weapon in the second degree after he was involved in the robbery of a credit union.
