Appellant was put to trial upon an indictment which, omitting the formal parts, reads as follows:

“The GRAND JURY of said County charge, that, before the finding of this indictment CLEVEN DIXON whose name is to the Grand Jury otherwise unknown than as stated, did unlawfully assault Joseph Harry Puckett, a law enforcement officer of the Police Department of the City of Mobile, Alabama, a political subdivision of the State of Alabama, with a shotgun, a deadly instrument, while said officer was engaged in the active discharge of his lawful duties, against the peace and dignity of…
