Appeal from an order of the Supreme Court (Graffeo, J.), entered October 10, 1997 in Albany County, which denied third-party defendants’ motion for summary judgment dismissing the third-party complaint.
Third-party defendants, Harold E. Rist and Ruth M. Rist, were directors, corporate officers and majority stockholders of Glens Falls Communications Corporation (hereinafter the corporation), a business engaged in providing long-distance telephone service.
