Defendant on December 7,1970, pled guilty to the misdemeanor of operating an uninsured mini-bike (Vehicle and Traffic Law, § 319) and was sentenced to pay a fine of $100.
On January 21, 1971, he made the instant motion for a writ of error coram nobis to (1) withdraw his plea of guilty, (2) vacate the judgment of conviction and to remit the fine because he was not represented by counsel and (3) because he was, in fact, insured on October 25, 1970, the date of the ticket.
