This case presents a question regarding the scope of the opinion of the United States Court of Appeals for the Fourth Circuit, rendered upon appellate review of this Court’s denial of the motion of Merritt Commercial Savings and Loan, Inc. (“Merritt”) to intervene into litigation between the trustee and the Board of Supervisors of Fairfax County, Virginia (“Fairfax County”).
