Affirming.

About ten months after sustaining an injury in the appellant’s mine, the appellee, Dill Hooker, filed his application for compensation under the Workmen’s Compensation Act, alleging that on April 15, 1927, while laying a mine track, a rail flew back and struck him in 'the abdomen, causing a rupture. He testified that the bank boss and another superior employee saw the accident, or saw him shortly thereafter.
