This is a proceeding under the act entitled “An act to provide for the adjudication and payment of claims arising from Indian depredations” (1 Sup. B. S., 2ded.,p. 913). Claimants allege that in* the year 1878, they were the owners of a large amount of property, to wit, 29 head of horses and colts, and 400 head of stock cattle in Happy Yalley, in the county of Grant, now Malheur County, State of Oregon; that the Piute and Bannock Indians, then in amity with the United States, took and destroyed said property without just cause or provocation on the part of the owners; and that the claim was…
