I. We do not consider it necessary to notice but a single one of the numerous questions presented in this record. The point made by counsel for the defendant in error, under the third head of his brief, we regard as radical, and practically decisive of the rights of the parties. Under this head it is contended that Brown having . failed to appeal from the decision of the board of county commissioners upon his claim, that decision was final and conclusive of the rights of all concerned.
