You have requested our opinion as to whether an appropriation by the Anne Arundel County Council for fiscal year 2008 related to school construction violated the State law governing school construction funding. When the County budget was adopted, the funds in question were appropriated to a capital project in the County's budget, but not to the budget of Anne Arundel County Board of Education ("Board of Education"). Under local law, these funds could be used for specific school projects only if the County Executive and the County Council agreed to a supplemental appropriation…
