In this action, plaintiffs granted defendant General Telephone Company of Michigan a right of way across their property for the placement of underground telephone cables. By the terms of the agreement, defendant General Telephone retained responsibility for damages suffered by plaintiffs from the installation or maintenance of the underground cables.

Defendant General Telephone subcontracted the trench-digging work to defendant Sub-Surface Construction Company. Plaintiffs allege that the trench digging caused serious vibrations in their home resulting in damage to their ceilings and stonework.…
