Appeal from circuit court, Rensselaer county. Action by John Robert, as administrator of William Robert, deceased, against the Troy City Railway Company, to recover damages for the death of plaintiff’s intestate. Plaintiff was nonsuited, and appeals.

This action was brought by the plaintiff, as administrator of the estate of William Dobert, deceased, to recover against the defendant for its alleged negligence in the management of its motor cars, by which the plaintiff’s intestate was killed. The facts disclosed by the evidence are briefly as follows: On the 3d day of January, 1893, the intestate was riding in one of defendant’s motor cars in the city of Troy, going in a southerly direction along River street, on the westerly track of the railroad at that point.
