Appeal from an order of the Supreme Court, Erie County (John F. O’Donnell, J.), entered Februaiy 11, 2009 in a medical malpractice action. The order denied the motion of defendants Michael Roberson, M.S., ET. and Catholic Health System, doing business as Kenmore Mercy Hospital, for summary judgment.

It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
