The parties hereto were candidates in the Democratic municipal primary election on July 16,1946, for the office of Mayor of the City of Biloxi. The original count showed the nomination of Cousins by a majority of one hundred and seventy-five votes. At the general election on August 12th, he was declared elected. Upon contest duly made by appellant, certain irregular and illegal votes were thrown out, resulting as follows: Cousins one thous- and nine hundred and seventy votes, Chinn one thousand eight hundred and fourteen votes, or a majority of one hundred and fifty-six in Cousins’ favor.
