This case is before the Court for review of the Fifth District Court of Appeal’s decision in Taylor v. State, 96 So.3d 989 (Fla. 5th DCA 2012), which the Fifth District certified is in direct conflict with the decisions of the First District Court of Appeal in Slocum v. State, 95 So.3d 911 (Fla. 1st DCA 2012), and the Second District Court of Appeal in Cooper v.
