William S. Ondo (“Defendant”) was found guilty following a jury trial of committing the class C felony of second-degree domestic assault, in violation of section 565.073. 1 The court sentenced him to serve three years in the Department of Corrections. Defendant appeals, contending the trial court erred in failing to sua sponte declare a mistrial when the arresting officer testified about Defendant’s belligerent and resistant behavior as he was confronted by police.
