At the August, 1941, term of the Grayson circuit court the grand jury returned an indictment against the appellant charging him with the offense of maliciously shooting and wounding W. A. Smith, sheriff of Grayson county, with intent to kill said Smith. Upon a trial of the case the jury found appellant guilty as charged.in the indictment and fixed his penalty at 15 years in the penitentiary.
