Crouch, J.:

The defendant was convicted of rape in the first degree. The commission of the crime was sufficiently proved. The sole question was whether or not the defendant committed it. He was identified by the complaining witness, a child about nine years of age. The *447only corroborating evidence was given by a woman residing nearby who testified that she saw defendant on the morning in question about ten minutes to eight standing in the street or in the entrance in front of the premises where the child lived; that he was standing still and muttered something.
