— Proceeding pursuant to CPLR article 78 to review a determination of the respondent Commissioner of New York State Department of Social Services, dated December 22, 1981 and made after a statutory fair hearing, which affirmed a determination of the Commissioner of the Suffolk County Department of Social Services denying petitioner Emergency Assistance for Adults, pursuant to 18 NYCRR Part 397. Petition granted, determination annulled on the law, without costs or disbursements, and respondents are directed to pay petitioner’s utility arrears for the four-month period in question.
