OPINION

LUMPKIN, Vice Presiding Judge:

John Wayne Duvall, Appellant, was tried by a jury for the crime of Murder in the First Degree in the District Court of Stephens County, Case No. CRF-86-251. Appellant was represented by counsel. The jury returned a verdict of guilty and recommended punishment at death after determining the aggravating circumstances that the defendant was previously convicted of a felony involving the use or threat of violence to the person, and that the murder was especially heinous, atrocious or cruel.
