Plaintiff here seeks to prohibit certain action in a cause in the trial court pending appeal to this court on the merits.

The action in the trial court is one to condemn real estate or a leasehold interest in real estate for right-of-way purposes for construction of the Turner Turnpike. Commissioners were duly appointed and made their report and ap-praisement or assessment of damage, fixing the same in the sum of $650.
