I. INTRODUCTION

Pursuant to verdict, the defendant-appellant, Frank Hernandez, was adjudged guilty of violating Neb. Rev. Stat. §§ 28-405(a)(4) [Schedule II] and 28-416(1)(a) (Reissue 1989) by possessing with the intent to deliver a controlled substance, cocaine. He was thereafter sentenced to imprisonment for a period of not less than 3 nor more than 5 years.
