On the 27th day of September, 1929, the wife of ap-' pellee was driving south in an automobile and along a road or street in the unincorporated village of Lauder-’dale, which said street runs parallel with, and on the east side' of, the railroad track of appellant at a distance generally of slightly less than fifty feet.
