The Estate of Phyllis DeLaRosa appeals the summary judgment entered in favor of Farmers State Bank with respect to claims pertaining to the misappropriation of funds by a fiduciary. On appeal, the estate claims its evidence demonstrated the elements necessary to succeed under the Uni form Fiduciaries Law. The judgment is affirmed in part and reversed in part.
