This is an action for an accounting of the profits made upon the purchase and sale of the assets of Conrad Green which had been assigned by Green to the Marine Bank of Buffalo for the benefit of creditors, and purchased from said assignee by the defendants, and afterwards sold by defendants, apparently at a profit. The plaintiffs claim a share of said profits by reason of a contract made by defendants with them, dated December 16, 1921.
