On October 15, 1982, appellees, husband and wife Frederick and Josephine Pearl, filed a joint bankruptcy petition with the United States Bankruptcy Court for the Eastern District of New York, Boris Ra-doyevich, Judge. The question presented by this appeal 1 is whether it was proper for the bankruptcy court to allow the debtors-appellees, over the objection of creditor-appellant John T. Mather Memorial Hospital, to aggregate a New York State “homestead exemption,” and thus receive the benefit of a real property exclusion from their estate of up to a maximum of $20,000, rather than $10,000.
