The plaintiff brought this action to determine adverse claims as the owner of the undivided two-thirds of the N. E. yi, section 24, township 112, range 80, situated in Peoria township, Hughes county, S'. D. The defendant Robinson claimed to be the owner of the whole of said quarter section by virtue of a tax deed issued in 1910 upon a tax sale for the taxes of the year 1902, which deed was recorded on February 24, 1910.
