This suit was instituted by J. W. Davis against the Houston & Texas Central Railroad Company, the Gulf, Colorado & Santa Fe Railway Company and the Texas & Pacific Railway Company, to recover $725 as damages to a shipment of twenty-nine head of horses from Toyah, Reeves County, Texas, to Llano, Texas, made May 10, 1906, over said lines of railway.

A jury trial resulted in a verdict and judgment in favor of the plaintiff against the Texas & Pacific Railway Company for $129.92; against the Gulf, Colorado & Santa Fe Railway Company for $259.85, and against the Houston &…
