The assignments of error in this cause are sixty-seven in number, of which fifty-five are relied on for a *455reversal of the judgment. We shall consider only such as we deem of any importance, passing by without notice all such as are either not supported by the record or present points unnecessary to be considered.
We think the service upon defendant, and the return of the same, are sufficient under our Revised Statutes. These statutes are not to be construed strictly as in derogation of the common law, but liberally, and with a view to effect their objects and promote…
