This action is brought in the names of three plaintiffs and each sets forth a separate and distinct cause of action in one of the three counts of the complaint. The defendant pleads in abatement and to the jurisdiction on the ground that as these claims are not founded on contract, they cannot be united in one action in this court under the provisions of section 5457 and 5458 of the General Statutes, Revision of 1930, and therefore the action is to be treated as one action in which the total of the sums demanded in the three counts exceeds the jurisdiction of this court.
