ORDER

WINGATE, District Judge.

Before the court is the motion of the defendant for sanctions requesting attorney fees in the amount of $4,391.37 pursuant to Rule 11 of the Federal Rules of Civil Procedure 1 and 28 U.S.C. § 1927. 2 Having now prevailed in this tort action, defendant contends that plaintiff’s contentions were frivolous and meritless from the outset and that plaintiff should be held financially accountable for his baseless lawsuit.
