The plaintiff is an association, organized under the general laws of the state, and this action is brought to recover a penalty of $25 for an allegéd violation of the rules and regulations of the association.
By section 47 of the law governing cemetery associations (Laws of 1895, Chap. 559), it is provided that “ The directors of a cemetery corporation may make reasonable rules and regulations for the use, care, management and protection of the property of the corporation and of all lots, plats and parts thereof in its cemetery; * * * for regulating the introduction and care of plants, trees…
