WOODBURY, Circuit Judge.

This appeal is from a judgment for the defendant entered upon a directed verdict in an action brought to recover for personal injuries received when an automobile in which the plaintiff was riding as a paying passenger collided with one of the defendant’s locomotives at a grade crossing. The plaintiff is a citizen and resident of Puerto Rico; the defendant is a corporation organized under the laws of the State of New York, but doing business in Puerto Rico.
