Opinion of the court on the demurrer to the petition.

On February 1st, 1913, the relator, August Leineweber, filed his petition in this court wherein he states:

“That he is a resident and citizen of the city of Cincinnati, residing at No. 2111 Winchell avenue in said city, and is a consumer or desires to become a consumer of the gas product of the defendant company at that place; that the defendant, the Union Gas & Electric Company, is a public utility corporation organized under the laws of Ohio and engaged in the business, as public utility company, of supplying gas for light, heat and power…
