In an action, inter alia, to recover damages for dental malpractice, the defendant Darshan J. Panchal appeals from an order of the Supreme Court, Suffolk County (Pines, J.), dated *706June 17, 2009, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is affirmed, with costs.
