CHAVEZ, Justice.

This is an appeal from a summary judgment in favor of appellee.

Appellant filed suit against appellee, asking damages for injuries received by her while she was helping her husband shingle a house which was being constructed by appellee in Farmington, New Mexico. Appellant’s complaint alleged that appellee entered into a contract with John E. Srader, Jr., her husband, to shingle said house; that she was lawfully upon the roof of said house assisting her husband in carrying out his contract; that appellee had negligently failed to cover a large floor opening in said roof with…
