The Town of Framing-ham (“Framingham”) files this lawsuit against Natick Mall, LLC (“Natick Mall”) alleging that Natick Mall owes $688,335.32 for use of Framingham’s sewer system. The amount sought is for the period July 1995 to December 2007, a period when Framingham mistakenly underbilled Natick Mall. Framingham admittedly failed to bill Natick Mall for the full amount of sewer usage until Framingham conducted an audit commencing in 2009.
