Smith, Justice.

Johnnie Johnson appeals the denial of his petition for a writ of habeas corpus. Johnson is under sentence of death for murder. He received in the same trial a twenty-year sentence for kidnapping, ten years for aggravated assault, and a life sentence for rape. Appellant’s convictions and sentence, including his sentence of death, were upheld on direct appeal to this court in Johnson v. State, 242 Ga. 649 (250 SE2d 394) (1978).
