delivered the opinion of the court :
The 4th section of the act under which this proceeding was instituted, directs a survey to be made of the outwai-d boun*73clary of the ponds to be drained; that a meeting of the proprietors shall be called, and they shall have a right to accept the charter and petition the Jefferson circuit court to establish the boundary of the corporation; and said court on receiving the petition, shall have power to establish or to modify the boundary if good cause to that effect shall be shown by the propriétors of said land residing within the boundary.
